외국인 범죄피해자, 불법체류자 통보의무 면제제도로 구제

경찰청은 코로나19가 완화되어 체류 외국인이 많아짐에 따라 외국인 범죄가 증가하고 있다 고 분석하고 단속을 강화할 방침이다 고 밝혔습니다.

 

중점 단속분야는 1) 출입국사범, 2) 투자사기.도박, 3) 범죄단체구성 등 조직범죄입니다.

 

외국인범죄는 외국인 간 또는 외국인 집단 간 이권다툼이 범죄가 진행되고 있어, 범죄피해자도 외국인인 경우가 많습니다.

 

그러나 불법체류자의 경우, 범죄피해를 당하면서도 불법체류 사실이 들통나 강제출국 당할까봐 신고를 못하는 경우가 많았습니다.

 

이에 경찰청은 ‘불법체류자 통보의무 면제제도’를 적극 시행할 방침입니다.

 

‘통보의무’란 경찰관이 수사과정에서 출입국관리법 위반 사항을 알게 된 경우, 출입국사무소에 외국인의 신상정보를 통보하는 제도인데, 이런 의무를 면제하겠다 는 것입니다.

 

사회적 약자인 불법체류자 외국인들의 인권침해를 구제하기 위한 제도입니다.

 

면제대상 범죄는 형법상 범죄와 성범죄, 교통사고 피해자 이거나 인권침해 나 차별행위 등을 당한 범죄 피해자인 경우 등입니다.

 

구체적으로 살펴보면 아래 항목 피해자가 구제받을 수 있습니다.

 

1. 형법 상 살인의 죄, 상해와 폭행의 죄, 과실치사상의 죄, 유기와 학대의 죄, 체포와 감금의 죄, 협박의 죄, 약취(略取), 유인(誘引) 및 인신매매의 죄, 강간과 추행의 죄, 권리행사를 방해하는 죄, 절도와 강도의 죄 또는 사기와 공갈의 죄에 해당하는 범죄 수사

 

2. 「폭력행위 등 처벌에 관한 법률」, 「성폭력범죄의 처벌 등에 관한 특례법」 또는 「교통사고처리 특례법」 위반에 해당하는 범죄 수사

 

3. 「직업안정법」 제46조제1항 각 호 위반에 해당하는 조사

 

4. 「국가인권위원회법」 제30조제1항 각 호에 따른 인권침해나 차별행위의 조사와 구제

 

5. 그 밖에 법무부장관이 정하는 업무

따라서 외국인 범죄피해자도 강제출국 우려없이 민원제기. 진정, 고소 등을 통해 구제받을 수 있을 것입니다.

It is a system to remedy human rights violations of socially disadvantaged illegal immigrants and foreigners.

Exempt crimes include criminal offenses, sexual offenses, victims of traffic accidents, or victims of human rights violations or discriminatory acts.

 

Specifically, the following items can be relieved by victims.

 

1. Investigation of crimes under the Criminal Code that fall under the crimes of murder, injury and assault, manslaughter, abandonment and abuse, arrest and imprisonment, intimidation, plundering, enticement and trafficking, rape and molestation, obstruction of exercise of rights, theft and robbery, or fraud and racketeering;

2. Investigation of crimes that violate the "Act on the Punishment of Violent Acts and Other Crimes", the "Special Act on the Punishment of Sexual Violence Crimes, etc.", or the "Special Act on the Handling of Traffic Accidents"

3. Investigations that fall under the violation of Article 46(1) of the Job Security Act

4. Investigation and remedies for human rights violations or discriminatory acts pursuant to Article 30(1) of the National Human Rights Commission Act

5. Other duties prescribed by the Minister of Justice
